Article 1 – Definitions

In these terms and conditions the following definitions apply:

Cooling-off period: the period during which the consumer can exercise the right of withdrawal.

Consumer: the natural person who does not act for purposes related to a profession or business and enters into a distance contract with the entrepreneur.

Day: calendar day.

Continuous transaction: a distance contract relating to a series of products or services where delivery or purchase obligations are spread over time.

Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.

Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period.

Entrepreneur: the natural or legal person who offers products or services remotely to consumers.

Distance contract: a contract concluded within a system organized by the entrepreneur for remote sales using one or more means of distance communication.

Means of remote communication: a method used to conclude a contract without the consumer and entrepreneur being physically present in the same place.

Terms and Conditions: these general terms and conditions of the entrepreneur.

Article 3 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

Before the distance contract is concluded the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible the consumer will be informed where the terms can be viewed and that they will be sent free of charge upon request.

If the distance contract is concluded electronically the terms may be provided electronically in a way that allows the consumer to store them on a durable data carrier.

If specific product or service conditions apply in addition to these terms the consumer may rely on the most favorable provision in case of conflicting conditions.

If one or more provisions of these terms are declared invalid the remaining provisions will remain fully applicable and the invalid provision will be replaced with a provision that reflects the original intent as closely as possible.


Article 4 – The Offer

If an offer has limited validity or is subject to specific conditions this will be clearly stated.

The offer is non binding and the entrepreneur reserves the right to modify or adjust the offer at any time.

The offer contains a complete and accurate description of the products and services offered. Images used are intended to provide a truthful representation of the products.

Obvious mistakes or errors in the offer do not bind the entrepreneur.

All specifications images and information are indicative and cannot lead to compensation or cancellation of the agreement.

Each offer clearly states:

The price excluding customs duties and import taxes for deliveries outside the European Union  
Any applicable shipping costs  
How the contract will be concluded  
Whether the right of withdrawal applies  
The method of payment delivery and execution  
The validity period of the offer  
Whether the contract will be archived and how it can be accessed  
How the consumer can check and correct submitted information  
Available languages in which the contract can be concluded  
Any codes of conduct to which the entrepreneur is subject  
The minimum duration of a continuous contract where applicable  
Optional details such as available sizes colors and materials


Taxes and Import Fees for Deliveries Outside the European Union

For deliveries to countries such as Canada or the United States:

Prices shown on the website do not include local taxes import duties or customs clearance fees.  
These fees may be charged by local customs authorities or by the shipping carrier at the time of delivery.  
Customers are responsible for paying these charges upon receipt of their order.

Where legally required local taxes such as GST or HST may be displayed and collected during the checkout process.


Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and complies with the conditions associated with it.

If the consumer has accepted the offer electronically the entrepreneur will confirm receipt of acceptance without delay. Until this confirmation has been received the consumer may cancel the agreement.

The entrepreneur ensures appropriate technical and organizational security measures for the electronic transfer of data and payment.

The entrepreneur may investigate whether the consumer can meet their payment obligations and may refuse an order or attach special conditions if justified.

With the product or service the consumer will receive:

The address where complaints can be submitted  
Information about the right of withdrawal or notification if this right is excluded  
Information regarding guarantees and after sales service  
All relevant information as described in Article 4  
Conditions for terminating the contract in case of continuous or long term agreements

In the case of continuous transactions these provisions apply only to the first delivery.

All agreements are subject to product availability.
